No order will be considered binding at Integrity Cigar until it has been accepted by us. Purchases from this website can be made using a valid credit card or PayPal for payment. Items will be shipped via UPS or USPS. Deliveries must be sent to an address where someone is present to sign for and accept the items. These terms and conditions of sale, along with the transactions they involve, are exclusively governed by the laws of the State of Florida, and any related claims must be filed and resolved solely in the courts of the State of Florida. By placing an order, you consent to all the aforementioned terms and conditions.

It encrypts all your personal data, including credit card numbers, names, and addresses, ensuring that it remains unreadable while transmitted over the Internet. Your information is of utmost importance to us, and we make additional efforts to secure your transaction and uphold this promise. We engage independent security services that monitor the website around the clock and provide alerts for any potential breaches.

PRIVACY

The data we gather will be utilized to inform customers regarding updates to our website and occasional promotions. We do not disclose this information to any other organizations for any reason.

LIGHTERS

Due to federal regulations lighters cannot be shipped by air. All orders containing lighters will be shipped by Ground only.

DISCLAIMERS

We maintain the authority to cancel and fully refund the customer in instances of typographical errors or honest mistakes that are evidently clear on our website. We will always strive to provide an amicable solution for any customer who feels offended in such cases, but there are times when shipping is simply not feasible in this context.

All gift certificates must be returned to us via mail in order to be redeemed. A purchase is necessary to redeem a gift certificate.

For brands that offer a gift certificate with every box, the box must contain a minimum of 20 cigars. Boxes containing 19 cigars or fewer necessitate the purchase of two boxes.

In cases where a second box or bundle is offered at a discount, the second box or bundle must be of equal or lesser value compared to the first.

The application of gift certificate credit is subject to the restrictions outlined in the “Gift Certificate Program.”

Regarding samplers and complimentary items – While we make every effort to fulfill each order as specified, we occasionally encounter an “out of stock” situation. We reserve the right to substitute items with those of equal or greater value.

For samplers that include cigars from various brands, we reserve the right to replace a specific cigar with a substitute of equal or higher value.

Please note that the colors, shades, sizes, and other physical characteristics of cigars displayed on this website may appear larger, smaller, or otherwise different from the actual cigars we offer.

RETURN POLICY

All items being returned must receive prior approval via email authorization. Returns should be made in their original packaging and in ‘new’ condition, as all products dispatched from our warehouse are sent in perfect condition. Any gift items must be returned alongside the items being sent back. If the gift item is not included with the return, its value will be deducted from the credit for the returned item. In the rare case that you have concerns about the quality of an item, you must inform us within 72 hours of receiving the merchandise to obtain a written return Authorization Number. Items that are returned or refused will incur a restocking fee of up to 50% or $15, whichever is greater. ‘Collector items’, lighters, or limited edition products cannot be returned. Cigar Samplers, Double Stacks, Cigar Combos, and Triple Deckers are also non-returnable. After obtaining an Authorization Number, please clearly mark it on the package next to the address label. All returns will be evaluated and will incur the relevant restocking fee and shipping charge, as all returns cannot be resold. Returns due to buyer’s remorse are not accepted. All orders from Integrity Cigar are processed automatically by our secure merchant processor and shipped as quickly as possible. During this process, we incur non-recoverable fees as part of the shipping, and therefore, we cannot cancel orders without charge. Any orders cancelled before shipping will incur a 7% cancellation fee (or a minimum of $10) before any credit is issued. Once an order has shipped, it cannot be cancelled and will be treated as a return with all applicable fees.

ORDER CANCELATION

Orders that have already been shipped cannot be canceled.

Any order canceled by the customer, or due to incorrect information provided in the order form, will incur a $19 cancellation fee, irrespective of the order’s total amount.

If the incorrect information relates to the customer’s date of birth, and it was entered to falsely indicate that the customer is 21 years or older (while they are actually under 21), a $29 cancellation fee will apply.

FRESHNESS GUARANTEE

We take quality control very seriously. All cigars we ship are either sent in sealed boxes or, for single sticks or 5-packs, in properly sealed bags. Most of the cigars included in our samplers are super-premium, and we do everything possible to ensure their freshness upon arrival.

All orders from Integrity Cigar are dispatched from our advanced climate-controlled warehouse located in Florida.

Additionally, all cigars are hermetically sealed in humidity-proof zip-lock bags, which contain patented WATER-PILLOW packets to maintain freshness.

That being said, I must emphasize that shipping individual cigars to the Pacific Northwest via GROUND service is not advisable, particularly during the summer months. Exposing the cigars to the high temperatures in standard postal or UPS trucks compromises all the benefits mentioned above.

We highly recommend purchasing cigars in their ORIGINAL factory-sealed boxes and shipping them cross-country by AIR rather than by ground.

ARBITRATION AND CLASS ACTION WAIVER

Please read this carefully. It impacts your rights. Any dispute or claim related in any manner to your use of Integrity Cigar services will be settled through binding arbitration, instead of court.

This arbitration agreement is meant to be interpreted broadly and explicitly includes claims made under the Telephone Consumer Protection Act, 47 U.S.C. § 227 et seq., or any other statute, regulation, or legal or equitable theory. You and Integrity Cigar agree that the Federal Arbitration Act, 9 U.S.C. 1, et seq. (“FAA”) governs this arbitration agreement and addresses all questions regarding whether a dispute is subject to arbitration. Unless otherwise agreed in writing by both parties, arbitration will be conducted according to the American Arbitration Association’s Consumer Arbitration Rules that are in effect at the time the arbitration is filed (the “AAA’s Rules”).

However, similar to a court, the arbitrator or arbitrators must respect the terms and limitations outlined in this Agreement and can award damages and relief (including any attorneys’ fees) permitted by law and/or the AAA’s Rules. The arbitration decision and award are final and binding, with certain exceptions under the FAA, and a judgment on the award may be entered in any court with competent jurisdiction.

YOU AGREE THAT, BY ENTERING INTO THIS AGREEMENT, YOU AND INTEGRITY CIGAR ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN ANY CLASS, REPRESENTATIVE, OR COLLECTIVE PROCEEDING.b

This Agreement prohibits class arbitrations, even if the AAA’s procedures or rules permit them. Instead, both you and we are limited to pursuing arbitration on an individual, bilateral basis. Additionally, unless you and Integrity Cigar come to a different written agreement, the arbitrator(s) cannot consolidate claims from more than one individual party with claims from any other party, nor can they oversee any type of representative or collective proceeding.

Both you and Integrity Cigar are accountable for our respective expenses related to legal counsel, experts, and witnesses, along with any other costs associated with the arbitration. However, Integrity Cigar will cover the arbitration administrative or filing fees, including the fees for the arbitrator and/or other AAA case management fees, for any claim that is $75,000 or less, unless the arbitrator finds the claim to be frivolous. In all other cases, the AAA’s Rules concerning costs and payments will apply.

This arbitration agreement does not prevent you from raising issues with federal, state, or local agencies. Such agencies may, if permitted by law, seek relief against us on your behalf.

If any provision of this Section (Arbitration and Class Action Waiver) is found to be illegal, invalid, or unenforceable to any degree, that provision will be excluded to the extent of its invalidity or unenforceability; all other provisions will continue to be in full force and effect. Furthermore, to the extent allowed and feasible, the invalid or unenforceable provision will be replaced with a valid and enforceable provision that most closely reflects the intent of the original invalid or unenforceable provision. Should the application of this Severability clause significantly and negatively impact the economic essence of the transactions contemplated herein, the adversely affected Party shall be entitled to compensation for such negative impact, provided that the reason for the invalidity or unenforceability of a provision is not due to serious misconduct by the Party requesting such compensation.
